I enjoyed most of the show.

Adrienne was great yelling at Deimos.

Belle was able to prove Deimos bribed the original judge. Go, Belle.

Interesting dress Nicole wore. Maybe she thought it would help in
the custody battle.

After yesterday's show of happiness with the wedding and Hope being there,
it was sad to hear about Julie's son David.
 
I also believe that Chloe was taken advantage of and ended up hooking due to seriously bad circumstances.

True, and I think many of us agree with that. Unfortunately, while team Chloe brought up all the dirt on Nicole, team Nicole did not bring up much of Chloe's dirt, nor did the explain why Nicole made a porn video. The judge was left with a unbalanced view of each woman's past and potential suitability as a mother.
 
Even though both Nicole and Chloe were forced/blackmailed to do what they did (porn and hooking), they still had choices. Nicole, however, was a teenager, while Chloe was ten or so years older. It doesn't matter that Chloe had no income; there were several things she could have done. Chloe had many friends, including the rich Brady Black, her former husband, who would have helped her. Both women could have called their blackmailers' bluff. They each chose the route they took, so I hope the judge sees it as a draw where their pasts are concerned.
 
Doug & Rafe have called everyone they can think of,
I like Rafe (although I'm getting sick of him), but how is this his job? Huge missed opportunity for the viewers to hear some Salem history from Hope (told to Rafe) about Scotty, David, Trish, etc.

I really hate that Justin didn't point out that NONE of Nicole's past deeds are relevant because Chloe agreed to be a surrogate KNOWING them. Let alone whether they may or may not have an impact on her parenting. She should have called Kinsey as a character witness. There's just so much "dumb" in this story (like the fact that it started because Chloe supposedly had the right to try over & over again to get pregnant using Nicole and Daniel's source material).

Oh, I just love that dancing lady. Well... to be honest, at the time, I thought the poor woman looked absolutely ridiculous. Then again, no more than Sami, who ran around her to jump on the man's (I forget who he was) back. Still, all this to say, that with all the gloom and doom going on in Days, that little dancing lady scene just makes me laugh. Thus, I love it ! So thanks, Jason.

Hey, we should put this scene up once in a while, in this thread or others, randomly or not, when the episode is so dark that nobody has fun. At least, we could laugh then.

:back: Seriously, I agree with everyone else. Justin did a terrible job. And if I were the judge, nobody would get Holly except Social Services. Not Chloe, not Nicole (it pains me to say that, as I hate what they are doing to Nicole, yet again). But based on the evidence submitted, Holly should not go to either one of these women.

So, once again, great job Days' "writers" ! :sarcasm:
 
@JasonD.........Justin did make the remark that none of the past is relevant to what is going on presently. He also only said he could list Chloe's misdeeds and they would be there all afternoon. However, I agree, over all, he did a lousy job, whereas Belle was much better prepared, and went through the entire litany of bad, bad Nicole.

Chloe really became a hard hearted Hannah, for sure. However, this all boils down to Nicole's refusal to break things off with Deimos, not even to get custody of Holly. This is supposedly why Chloe dug in her heels, but also, the longer Chloe keeps Holly, the greater is her attachment and then refusal to give Holly up, no matter what Nicole does.
 
I have only one thing to say about all this disconnect: bad writing.

Question for anyone who may know about family law. If this was real life, would Chloe have any grounds to keep a child that was not biologically hers?

Happy Days are over, as the gloom, misery and despair takes over Salem once again.
Those were my thoughts exactly. The glow from the Kayla-Steve wedding certainly didn't last long. No sooner is it over, then poor Julie (fresh from the stress of the Hope situation) is distraught over the off-screen death of her never-seen, rarely-mentioned son. Who wants to watch this? Killing off David was totally unnecessary. Instead, the writers should have sent Doug and Julie off on another festive cruise.
If this trial over custody of Holly was real life and I was watching it knowing all facts I would never hire Justin based on his performance today.
Justin did do an awful job. In addition to not dredging up all the dirt about Chloe's often-sordid past, he failed to note that unlike many surrogate mothers, she is not the biological mother of the child. He also should have stressed that the diva signed a valid contract to have the baby for the biological parents, and that by failing to turn the baby over to Nicole she is breaching that contract. He might also have maintained that all the allegations against Deimos are just mere gossip and hearsay. Belle presented no evidence to back up her claims that Deimos is a potential bad influence. After all, if memory serves, he's never been arrested or charged with a crime since arriving in Salem.
Depends on the state......some states give surrogates certain rights, others give entirely to bio parent. Dr. BakerFan has to weigh in on this.
As conjured up by the writers, the Nicole-Chloe case is an only-in-Salem situation. Illinois, where Salem is presumed to be, allows surrogacy contracts and by not giving Nicole the baby, Chloe has breached the contract. Chloe is also not the biological mother of the child (unlike the famous Baby M case from 1986), which weakens her case. Finally, all the truly bad actions by Nicole are in her past -- many in the distant past -- and do not reflect on whether she would now be a fit parent. Accordingly, if Nicole v. Chloe were heard in a real-life court, my best guess would be that Nicole would be awarded custody of her child.
 
Julie's loss would have much more impact if fans knew anything about him. Heck, killing off "Dancing Woman in Square" would have more meaning. We all remember her.

Completely agree. I hope we find out down the line that David is indeed still alive and this was all a setup.

When is Rafe going to know about Gabi and Chad, and anything involving his dad and brother?

Great minds Jason. I was going to post the exact same thought and then I read this. Huge missed opportunity indeed. Hope should have relayed the family background to Rafe as a way to introduce newer viewers to these characters.

I was sickened by the fact that Hope was at TBD with Rafe after finding out about her nephew-stepbrother. They should have gone with Doug and Julie to the house and while Doug and Julie went to lie down, Hope and Rafe could be in the living room with Hope explaining the backstory. I was equally sickened by the fact that Hope would be at TBD with Rafe rather than spending time with Shawn, Ciara and Claire since she just got out of prison. If they're not going to have her in the Julie story, then she should be with her family before her boyfriend. Right now she is acting no different than Nicole. And I would have felt the same way if Hope were at TBD with Bo or Aiden too. It just wasn't right.

I'm also annoyed Rafe doesn't know about Gabi or the Orwell stuff. He needs to be moved into that story. Both Hope and Rafe are completely unrecognizable right now as a result of this relationship. That's one of the reasons they are such a turn off for me.

Valerie's dress was way too short. That is all.

I liked Valerie's reaction to David's death and again needed some more backstory. I like Marlena with Valerie as well but only Dena Higley would have Deidre Hall (Marlena) pop up 2/3 of the way through an episode as support for a "newbie". I would have liked to have seen Marlena with Paul and Brady as well.

Agree that Justin did a lousy job. Belle was well prepared and I agree that some of the stuff she said was out of Nicole's control, however, that's typically how court cases go. Lawyers have to make their client look good. It was Justin's job to refute her when he had the chance to speak. He did not. I did like the twist about Belle finding out about Judge Pierce being bought off. And with Deimos bragging, I'm guessing this will play into the decision big time.

Chloe was a gestational carrier for Nicole and Daniel, not a surrogate. The show seems to use the terms interchangeably but they are not the same thing. If Chloe had been a surrogate, it would have been her egg with Daniel's sperm.

I think most people use the terms interchangeably (like ultrasound and sonogram). I've also seen the term "gestational surrogate", which is also a correct description of Chloe.

Out of curiosity, I've done a little more research on the gestational surrogacy issue, and it turns out that the Illinois surrogacy law addresses this question. The law requires a written contract, that both the intended parents and the surrogates be represented by counsel when it is prepared, has rules on who can be a surrogate, and goes on to state that in cases where there is a valid contract the "intended parents" are to have custody of the child. There is also case law from a few other states in which the "intended parents" were granted custody, not the surrogate. Accordingly, Justin should have argued the intent of the contract, which should have resulted in Nicole getting custody.
 
@JasonDíSpeech, thank you for posting the highly skilled Dancing Woman's clip; I missed the original performance. :) I would appreciate a clip of Ava's :)love:) dance, if possible.

@DrBakerFan, all this surrogacy talk brings to mind that case wherein the birth mother brought the child's definitely absentee biological father over from Germany to bolster her case. I really disliked that jerk! :angry:


Re the portion of Nicole's past involving that porn video, even given that she made it under duress, it would be rather traumatic for Holly to eventually see. Something else for the judge to consider. There was a moment during the hearing that I thought Nicole was going to make a Solomon's Choice decision, and cede her child to Chloe.

Why would living with Nicole mean Holly would see that video? She could just as easily have access to it being with Chloe. Doesn't matter who Holly's legal parent is, she'd still be able to pull up the video online or on the darkweb if she wanted to see it.
 
The show on Friday was pre-empted in my area because the president was here at the Boeing plant. Doesn't appear that I missed much. Thanks for filling in my blanks. The president also interrupted Thursday's show.

Real life is so different from soap life. Didn't Vivian give birth to Philip by stealing the fertilized egg of Victor & Kate?
