Happy Days are over, as the gloom, misery and despair takes over Salem once again.
Those were my thoughts exactly. The glow from the Kayla-Steve wedding certainly didn't last long. No sooner is it over, then poor Julie (fresh from the stress of the Hope situation) is distraught over the off-screen death of her never-seen, rarely-mentioned son. Who wants to watch this? Killing off David was totally unnecessary. Instead, the writers should have sent Doug and Julie off on another festive cruise.
If this trial over custody of Holly was real life and I was watching it knowing all facts I would never hire Justin based on his performance today.
Justin did do an awful job. In addition to not dredging up all the dirt about Chloe's often-sordid past, he failed to note that unlike many surrogate mothers, she is
not the biological mother of the child. He also should have stressed that the diva signed a
valid contract to have the baby for the biological parents, and that by failing to turn the baby over to Nicole she is
breaching that contract. He might also have maintained that all the allegations against Deimos are just mere gossip and hearsay. Belle presented no evidence to back up her claims that Deimos is a potential bad influence. After all, if memory serves, he's never been arrested or charged with a crime since arriving in Salem.
Depends on the state......some states give surrogates certain rights, others give entirely to bio parent. Dr. BakerFan has to weigh in on this.
As conjured up by the writers, the Nicole-Chloe case is an only-in-Salem situation. Illinois, where Salem is presumed to be, allows surrogacy contracts and by not giving Nicole the baby, Chloe has breached the contract. Chloe is also not the biological mother of the child (unlike the famous Baby M case from 1986), which weakens her case. Finally, all the truly bad actions by Nicole are in her past -- many in the distant past -- and do not reflect on whether she would now be a fit parent. Accordingly, if
Nicole v. Chloe were heard in a real-life court, my best guess would be that Nicole would be awarded custody of her child.
