Abigail confessed to killing Andre. Whether this constitutes murder or any other crime depends on her state of mind/intent at the time she swung the urn at Andre. A mere confession wouldn't necessarily cause Abigail to be held in custody. People make false confessions all the time. Recall the line from the film The Fugitive: "There's another Kimble on line three." Because officially Gabi murdered Andre, any Abigail confession would first have to be investigated to see if it can be corroborated.
