Jennifer and Abigail at the Horton house. Jenn has an envelope. She had Uncle Justin draw up papers because she has decided to divorce Jack. She is sorry this is hurting Abigail. It doesn't hurt her at all. She is actually relieved. She has every right to dump his sorry ***. He is still her father. Abigail is glad she is deciding to get on with her life. What changed her mind? A lot of things she tells her. She was out with a friend. Had a good time. It was great. For the last several months she put her life on hold to wait for a man. Abigail starts to cry and tells Jenn that she deserves much better. She looks up to her. Always have and always will. Jennifer knew there was a reason she loved having her around. Do they need Jack to sign papers? No, they are giving her an ex parte divorce. He doesn't need to participate but it will take a little longer. Jennifer doesn't want her to tell anyone about this. Abigail agrees and they hug. She tells her she is proud of her. She is doing the right thing. Daniel is now in the Horton living room. Oh, is he there for a rematch? She's up for it. Maybe another time. She is sorry. He is being serious. He tells her there has been a mistake. What is he talking about? Her divorce. How does he know that? Because her divorce papers were delivered to him by accident. He hired Justin to be his lawyer too. There must have been a mix up. She grabs her envelope and says this must be his. They check and it is. He tells her he won't say anything about her divorce. She asks him how he is? He is upset. He alternates between being angry and feeling a little responsible. Only an idiot wouldn't have seen how much Chloe was hurting. That doesn't excuse what she did. He realizes he could have prevented this. If only he had been more loving, attentive. He is wrong. He is an idiot. Why would he blame himself for his divorce? He falls in love with this woman who sleeps with another man and gets pregnant with his baby. Not only does she cheat on him, she gets pregnant because she didn't think to use birth control or ask Philip to use it either! They didn't thinks he could conceive so...Well she sure was wrong wasn't she? He guesses so. It is kind of cool to have a friend who is so direct and tells it like it is. It is very refreshing he tells her. Good cause he hasn't seen anything yet. Great! He better check on Mel. Sorry for the mixup but it had to be for a reason. The oven dings. Her cookies are done. She leaves the room and he takes off his wedding ring and puts it in his pocket.

Melanie and Daniel at Daniel's Apartment

Melanie tells Daniel she is heading out as he grabs an envelope off the table. Melanie is headed to Salem PD to check on the guy who tried to rob her. He is coming too. The guy tried to rip his baby girl off and he is going to rip his head off. Melanie tries to stop him. Daniel just wants to scare him a little. Melanie handled it. She cannot go with her daddy so he can protect her. Ok, she can handle her own. Melanie leaves. Daniel gets the envelope. He looks at the papers...

Gabi, Justing and Will at Justin's Office

Gabi is pleading with a Justin that Dario is a good guy. He has a long rap sheet. They are all misdemeanors she points out. True, but with this kind of history it will be tough to get these charges to go away. Yeah, but they can do it, right? Will tells her that he stole a pair of $1,000 earrings from her and more from a bunch of other people. Yeah, but he is her brother and she needs to help him. She can't turn her back on him. Will he please take Dario's case. He cannot promise miracles but he will do the best he can. Gabi should call Rafe, but then again he probably wouldn't care. Why? Gabi tells Justin he isn't himself. Memory loss, he heard. His whole personality changed she tells him. When he saw Dario he was cool and distant, like Dario was a complete stranger. Justin takes a call. Is she sure Dario doesn't already have an attorney? There is confusion at the PD. They have to go. Gabi and Justin leave.

The man he was meeting with on the pier walks into the interrogation room with Dario. The girl introduces him as Dario's lawyer. She leaves and he tells Dario that his legal knowledge extends as far a Law & Order. That's not why he wanted him to come. What he needs form him is more important. Does he have what Dario asked for? he gave him plenty of money. Forget it. He is done. He tried is best. Dario is now on his own. The man leaves. Dario is brought out to the main area when Gabi and Justin walk in. Justin introduces him as Dario's attorney. She thought the other guy was his lawyer. He fired him he tells her. They have a few minutes before he has to go back to holding. He thought he made it clear? He doesn't want Gabi's help? Justin says he knows the Judges and he thinks he can get him released without bail. Maybe he should appreciate Gabi because that is how he may be out of there in less then an hour. Enter Melanie. What? She is absolutely NOT going to let that happen. Gabi says her brother didn't mean it! That is her brother? That is funny he is Rafe's brother. Rafe will do whatever it takes to get him off scott free. Gabi goes on about how is going to mend his ways, he regrets it, etc. Melanie said he does not look like he cares. He says the only thing he regrets is not having earplugs as her shrieking is giving him a headache. Wait until she gets done with him she tells him. He asks if she is high strung because she is not getting any or what? She lunges at him. Justin holds her back. McCarthy holds back Melanie and tells Dario she is gonna beat the hell out of him. With those baby fists of fury? McCarthy tells her she has to leave. What? She is the good one here. He stole from her. They already have her statement and she better leave before she is arrested. She says fine and tells Dario she is not done with him. She leaves and he says kind of cute. Takes herself wayyy to seriously though. Justin gets a call from a Judge. Dario thanks her for finding him the fancy lawyer. Why did he sneak back into town>? If he was in trouble her and Rafe would have helped him. Forget it. Why is he being this way? Because they both let their sister Arianna down. She is dead and they don't give a damn. SHe goes on about how sad she is that Arianna is gone. She can;t just stop her life because Arianna wouldn't want that. She was full of life and would want Gabi to be that way too. Don't ever, EVER tell her that she doesn't care that her sister died. Does he hear her? He does and he is sorry. He just don't understand why. Why they haven't figured out who killed her. Someone just runs her down and doesn't stop and 6 months later they just don't know who it was?!? He is going to find out who killed her. Is that why he is here? Why he came to Salem? He hired a PI. She is guessing he didn't find anything? No, he quit because of Dario's arrest. Rafe2 comes in and tells Dario they need to talk. Rafe2 tells him that this whole theft thing he has going on reminds him of when he was a teen adn stole those hubcaps. Tried to help him then but Dario wouldn't let him. He is his brother and he is not going to abandon him, but he thinks that he needs to pay for the crime. He needs to do the time. Gabi wants to know what Rafe2 is doing. Rafe2 is sick of it and no more excuses. Justin comes up and tells Dario he is free to go home. He is what Rafe2 asks? Justin got him released immediately. Gabi wants to know if Dario can stay with him and Sami in their extra bedroom (I assumed they were staying in a two bedroom...)???
 
Taylor/EJ at DiMansion

Taylor is getting ready in her room. She looks in the mirror at herself and flashes back to seeing EJ in the living room with no shirt on. EJ comes too from daydreaming when Chad walks in. He came to see Stefano. Know where he is? EJ tells him that he is not there. He will tell him that he stopped by. When will he be back? Next time why doesn't he call? That way he doesn't waste a trip. He is busy. Is there anything he can do for him? No, no. He wouldn't want to take up anymore of his precious time and leaves. Taylor walks in. What is going on down there? Was that Nicole? No, it was his brother. Nicole is running errands. She gets up to leave. He tells her they have the house to themselves. He thinks it is about time they have a chat. About what? He threatens her about feeding information to Brady while she is living there and working with him. She is a spy or didn't he know that already? She should get going. Can't be late for her first day of work. She asks him how he really feels about her sister. They don't have a conventional marriage. She heard Nicole's side and now she wants to hear his. He says he loved her sister very much once. It was followed by a rather intense period of loathing. And now? Now he finds that he has reconnected with many of hte feelings that he first had. She has this wonderful energy. An infectious appetite for life and she makes him very happy. But it is not love Taylor asks? She is a wonderful mother to his children and that is very important to him. He loves to be in her company. TO answer her question, he does love her sister, but he is not IN love with her sister. But he married her! Why? When he proposed, he was feeling cynical about his capacity to love. At the time it didn't make a difference to him. He takes Taylor's hands in his. HE didn't feel that it was possible for him to...he just didn't think it was possible for him to feel that way about anybody. They stare at one another...He married Nicole because he was cynical? She is a wonderful mother to hte kids and that is extremely important to him. He assures her that Nicole is happy with their arrangement. No she isn't Taylor tells him. Why would she say that>? Because she doesn't want an arrangement. She wants a marriage and wants to be loved. If she wants that, that is not with her. He couldn't be more wrong she tells him. Nicole is in love with him. He doesn't believe it. He doesn't see the way she looks at him? It is not obvious to him. If he finds himself having feelings for someone....it is not about what he wants she tells him. Why not? Why doesn't his feelings count? For the first time in his life...she interrupts and tells him not to say anything else. Please. Her sister is close to having everything she ever wanted. All that is missing is the husband that loves her back. She is not going to be the one to ruin it. She tries to leave and he steps up in front of her. Please let go of her. She tells him that she can;t do this. Sure she can. He leans in and kisses her. She kisses him back too.


Stefano and Rafe2 in the DiMera Basement

Stefano and Rafe2 walk into the basement. Rafe2 asks where Rafe is. Our dear friend is no longer with us. Did he kill him? He has just been removed to a different place to start his life a new. Rafe2 is walking around with his face and doesn't just want to bump into him. Stefano assures him this won't happen. He is far away. Stefano tells him he got more intel on Dario. Memorize it backwards and forward. The loser is in jail. Stefano yells at him not to be a fool. He has to go in there and prove to his brother that he is the brother that he grew up with! He should stay away from him Rafe2 thinks. Not until he assures him he is his aramano (I think that is what he said.) Rafe2 agrees and sits at the table. God, he is an idiot. He is a total screw up. Rafe would never give up on his family. It is not like him. Rafe2 says this job would be a whole lot easier if Rafe wasn't a saint. Everyone worships Rafe's ***. Dario is not going to care so much. Stefano thinks this is in their favor. He will be examining everything. Stefano tells him to be on top of his game. Rafe2 says he is not a clone. This guy may see through the act. He better leave. He is already late. Don't try. Win. His life depends on it.

Abigail, Will and Chad at Java

Abigail is at Java cleaning up her mess when Will walks in. Is everything OK? Yeah. He doesn't think so. She says she is not fine at all. Her life is a mess. A horrible depressing mess. What is going on? HE has to promise not to even tell Gabi. OK. Or his dad or anyone in their family. He promises. She tells him that Jennifer is divorcing Jack. Will is so sorry. She gets upset and then Chad comes up behind her. HE is sorry. He didn't mean to eavesdrop. Abigail asks for a minute alone with Chad. Sure. Will prepares to leave. How much did he hear? Not much. What did he hear? That her parents are getting divorced. She knows they are not friends but...he interrupts and says he is not going to tell anyone. She appreciates it. See? Those DiMeras can be moral and trustworthy after all! HA! Shocker! She just wishes that her dad wasn't such a jerk. They were once really close now she never hears from him. He knows what that is like. He tells her about the DA not caring anymore. What about Stefano? Are they close? That is overstating it he tells her. Abigail says that she is sorry for being mean when she found out he was a DiMera. She wouldn't want to be judged for her dad's behavior. Not that he was ever involved in crime like....she stops herself. She almost stuck her foot in it. It's OK he tells her. He doesn't want his friends walking around on eggshells because they are afraid of him. They and he shouldn't have to she tells him. Just like he doesn't want to hide from or ever forget that he was once a father himself. To Grace she says...oh, she remembered her name he says. Yeah. Well, Grace made him realize how much he wants to be a dad one day. A real dad in every sense of the word. Maybe she is one fo the reasons. What Abigail asks? At first he wanted nothing to do with the DiMera's. He didn;t even know that Chad existed until a few months ago. All of a sudden Stefano wanted to be a part of his life and he knows that feeling. Of wanting to be there for your kid and making up for lost time. That is how he can relate to Stefano wanting him in his life? YEah, he can. He can see the pain in his eyes knowing he missed out on all those years with his son. He gets it. He knows how he is feeling.

Melanie and Will at the Pier

Melanie runs into Will at the pier. She tells him that she is disgusted that Dario may get off and not even have to pay bail. Would he do her a favor and pass along a message? They are really gonna want to hear this. Tell the Hernandi that even if Rafe manages to get him a free pass, then he still has to deal with Melanie. he will pass it along. Will walks away and Melanie shouts after him. She stomps up the stairs.

There was no clip for tomorrow on Days.
 
Oh, wow, an unexpected pleasure, missvicki...thank you so much. So Dario wants to find out who ran down Arianna. And inspite of the police investigation.....no leads. I hate Jennifer filing for divorce...but not unexpected. Interesting that Jack doesn't even have to be notified.

The summary says that Jack doesn't have to participate, but that it will take longer. I suspect that means that they have to show that they attempted to notify him and allow him a certain amount of time (probably 60 days) to respond. That's how it worked when my husband adopted my oldest daughter 8 years ago. We had to attempt to notify her biological father and allow him time (I think it was 60 days, could have been 30) to contest it if he wanted to.
 
Yep B2, you are right. All Jen has to do is attempt to notify Jack. As long as she can prove that she reasonably attempted and he did not respond, then the divorce will proceed without Jack.

I knew a guy who met a girl off the internet and married her. Before the first month was out, she just up and left one day and he never heard from her. After a couple of weeks, he filed for the ex-parte divorce and they had to take ads out in the newspaper here in the state they were married and then in the state that she lived in when they met and possibly even sent an email or two. Then he also had to have copies of the ads to show that it was indeed in the papers and copies of any emails or recordings of phone calls. I think the response time was 30 days for his but I may be wrong about that.

Since Jennifer knows about the blog and how to leave Jack messages, I would assume that she would have to nofify him by both means in order for the divorce to proceed. However, I doubt that we will see that or tptb will use the past couple of months with no contact from him as a way to "speed it up" even tho the communication has to come AFTER the paperwork has been filed.

What is with the Horton Women. Julie and Maggie telling Nathan to go after Melanie when she's still married to Philip. Now Jennifer telling Daniel he has no responsibility in what has happened between Chloe and Daniel, which lead to her indiscretion. The heck he didn't!

Then Melanie she is certainly a good healer....did you see how she pounded her feet going up the stairs after talking to Will....how could someone that had just had a miscarriage do that, not to mention once again attack Dario in the police station?
 
Thanks for the writeup, missvicki. So glad to get to read before watching. I just finished watching yesterday's show, now am about to see today's.

In our modern world of "no fault" divorce, it doesn't matter much what one party thinks about it anyhow. If the other one wants a divorce it's a done deal. It's almost as though notifying them is merely a formality or a courtesy. Maybe not technically but in essence.

Looks like everybody in Salem is going to know about Jenn divorcing Jack long before Jack does. Maybe even before the papers get processed. lol...

Had to laugh at Gabi saying Dario didn't mean it. She's taking "giving the benefit of the the doubt" to a whole new level.
 
I've seen friday's show and I gotta say melanie and dario are so going to hook up.
 
Steffee, I really agree with you about Jennifer today. I love Jennifer, but for her to tell Dan that none of this was his fault was totally silly. She hasn't been in town, she hasn't spoken to Chloe, she has no idea what the situation was or how many times Chloe tried to talk to Daniel about things. I understand she wants to support the man who saved her life AND she's been hurt terribly by Jack, but it seems a little out of character for Jen to be so judgemental of someone she barely knows. BOTH Chloe and Daniel made mistakes in the relationship and to tell Dan none of it was his fault will only feed his already large ego and his sense of "I can do no wrong" where women are concerned.

Sorry for the rant, but like I've said before, I'm a little tired of Chloe being the only one to be the whipping boy in this whole situation.
